These Terms and Conditions (the “Terms”) govern your access to and use of www.jewelixatelier.com (the “Site”) and your purchase of products or services from Jewelix Atelier. In these Terms, “Jewelix Atelier,” “we,” “us,” and “our” refer to the business operating the Site, with its registered office at 30 N Gould St, Ste R, Sheridan, Wyoming 82801, United States of America. “You” and “your” refer to any visitor, customer, or purchaser using the Site.
By accessing the Site, creating an account, placing an order, or otherwise using our services, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Site or place an order.
Nothing in these Terms excludes or limits any consumer right that cannot lawfully be excluded or limited in your country or state of residence.
1. Eligibility and Use of the Site
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to place an order. By using the Site, you confirm that you have the legal capacity to enter into a binding contract and that the information you provide is accurate, current, and complete.
You may use the Site only for lawful personal or legitimate business purposes. You must not misuse the Site, interfere with its security or operation, introduce malicious code, attempt unauthorized access, scrape content without permission, or use our content or products for fraudulent or unlawful activity.
2. Accounts and Guest Checkout
You may purchase through a customer account or, where available, as a guest. Guest checkout does not automatically create a customer account.
If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for activity conducted through your account. Please notify us promptly at support@jewelixatelier.com if you suspect unauthorized access or use.
We may suspend or close an account where reasonably necessary to protect customers, prevent fraud, enforce these Terms, or comply with law.
3. Product Information and Jewellery Characteristics
We aim to describe and display our jewellery accurately, including metal type and purity, diamond or gemstone type, carat weight, dimensions, colour, clarity, setting, certification, and other material characteristics where applicable.
Because jewellery is handcrafted and laboratory-grown diamonds and gemstones may have individual characteristics, minor variations may occur in colour, shade, dimensions, weight, finish, setting, and appearance. Carat weights and measurements may be approximate and subject to customary manufacturing tolerances. Product colours may also appear differently depending on your device, display settings, lighting, and photography.
All diamonds sold by Jewelix Atelier are laboratory-grown diamonds. We do not sell natural or mined diamonds. Laboratory-grown diamonds, any treatments, other gemstones, simulated stones, and metal qualities will be identified in the relevant product description as applicable. The terms “diamond,” “lab-grown diamond,” or “laboratory-grown diamond” used on the Site refer to laboratory-grown diamonds unless expressly stated otherwise. You are responsible for reviewing the complete product description and selected options before placing an order.
Images may be enlarged to show detail and may not represent actual size. Packaging shown in photographs is illustrative unless expressly included in the product description.
4. Certification and Grading
Where a product includes an independent grading report or certificate, the applicable laboratory will be identified in the product description or order documentation. Not every item or stone is independently certified.
Diamond and gemstone grading represents the independent laboratory’s professional opinion at the time of grading and is not a guarantee by Jewelix Atelier that another laboratory or appraiser will assign identical grades. A grading report is not a valuation or appraisal. Certification details and report numbers may be subject to verification before dispatch.
5. Custom, Personalized, and Made-to-Order Products
“Custom or Personalized Products” include items made, engraved, resized, modified, or sourced to your specifications, including selections relating to ring size, metal or gold purity, metal colour, diamond or gemstone, setting, inscription, dimensions, design, or other individualized requirements.
You are responsible for checking all specifications, spelling, sizes, measurements, design approvals, and other instructions before approving production. Once production, stone allocation, engraving, resizing, or sourcing has begun, changes or cancellation may not be possible and may involve additional charges.
Computer-aided design images, renders, sketches, and samples are visual guides. Reasonable differences may arise in the finished handcrafted product due to scale, materials, stone proportions, setting requirements, and manufacturing tolerances.
Custom or Personalized Products are generally final sale and are not eligible for change-of-mind return or exchange, except where required by applicable law or where the item is defective, damaged on delivery, materially different from the approved specifications, or incorrectly supplied by us.
6. Pricing, Currency, and Errors
Prices are displayed in the currency shown on the Site or at checkout. Currency conversions displayed by the Site or a payment provider may be estimates, and your card issuer or bank may apply its own conversion rate or fees.
Unless expressly stated otherwise, prices do not include import duties, customs charges, brokerage fees, local taxes, or similar government charges payable in the destination country.
We take reasonable care to ensure pricing and product information are accurate. If a material pricing, typographical, technical, or description error occurs, we may contact you for instructions, correct the error, or cancel and refund the affected order. We will not knowingly enforce an obviously incorrect price.
Prices and promotions may change without notice, but changes will not affect an order already accepted by us, except where required to correct an agreed error or comply with law.
7. Orders and Contract Formation
After you place an order, we may send an acknowledgment email confirming receipt. This acknowledgment does not mean that we have accepted your order.
An order is accepted, and a binding sales contract is formed, when we send an order-confirmation or dispatch-confirmation email, or when we otherwise expressly confirm acceptance. For custom work, acceptance may also be subject to design approval, stone availability, production feasibility, and receipt of any required deposit or full payment.
All orders are subject to availability, payment authorization, fraud and compliance checks, shipping restrictions, and our ability to fulfill the selected specifications. Items in a shopping cart are not reserved until the order is accepted.
We may decline or cancel an order for legitimate reasons, including unavailability, suspected fraud, payment failure, sanctions or legal restrictions, incorrect pricing, inability to verify customer information, or inability to meet requested specifications. If we cancel after receiving cleared funds, we will refund the applicable amount to the original payment method, subject to law.
We may contact you if a selected stone or component becomes unavailable and may offer a comparable alternative. No substitution will be made for a material component without your approval.
8. Payment
Payment methods available to you will be displayed at checkout and may vary by country, currency, order value, and payment-provider eligibility. We may accept Shopify Payments and major credit or debit cards in supported markets, including the United States, United Kingdom, Australia, Canada, and Türkiye. Customers in other countries may use the card or other payment options made available at checkout.
By submitting payment, you confirm that you are authorized to use the selected payment method. Payments are processed by third-party payment providers and may be subject to verification, authorization, security checks, and the provider’s own terms and privacy practices.
Your order will not enter production or fulfillment until the required payment or deposit has been successfully authorized and received. We are not responsible for delay caused by a bank, card issuer, payment provider, incorrect billing details, verification request, or payment refusal, except to the extent required by law.
If a payment is reversed, charged back, or found to be unauthorized, we may suspend fulfillment, cancel the order, or pursue lawful recovery of amounts due.
9. Fraud Prevention and Verification
To protect customers and prevent fraud, we may request reasonable identity, billing, shipping, or payment verification before accepting or dispatching an order. We will handle personal information in accordance with our Privacy Policy and applicable law.
Failure to complete required verification may delay or result in cancellation of an order. We will never ask you to send a full payment-card number or card security code by ordinary email.
10. Production and Delivery Estimates
Ready-to-ship, made-to-order, and custom items have different preparation times. Any production or delivery date shown on the Site or communicated to you is an estimate unless we expressly agree in writing that it is guaranteed.
Delays may occur because of customization, stone sourcing, quality control, payment or identity verification, carrier disruption, customs clearance, severe weather, public holidays, force majeure events, or circumstances outside our reasonable control. Where a mandatory delivery deadline applies under local consumer law, your statutory rights remain unaffected.
If an order contains multiple items, we may ship them separately. We will provide tracking information where available.
11. Worldwide Shipping, Customs, Duties, and Taxes
We offer complimentary standard shipping to destinations we serve worldwide, unless a product page, promotion, or checkout expressly states otherwise. “Complimentary shipping” covers the shipping charge selected by us and does not automatically include import duties, customs fees, brokerage charges, local taxes, return shipping, remote-area surcharges, or other destination charges.
International orders may be inspected or delayed by customs authorities. Unless checkout expressly states that duties and taxes are included, you are the importer of record and are responsible for complying with destination-country requirements and paying all duties, taxes, customs charges, brokerage fees, and related assessments.
If you refuse delivery or fail to pay required destination charges, the parcel may be returned, abandoned, or destroyed. To the extent permitted by law, any refund may be reduced by non-recoverable duties, carrier charges, return costs, and other reasonable costs actually incurred. This does not affect rights that cannot lawfully be limited.
We may decline to ship to restricted destinations, freight-forwarding addresses, P.O. boxes, or locations that cannot be served safely or lawfully.
12. Delivery, Inspection, and Risk
Please provide a complete and accurate delivery address. We are not responsible for delays or losses caused by incorrect or incomplete information supplied by you, although we will reasonably assist where possible.
Signature may be required. Before accepting the parcel, inspect it for visible damage or tampering. If you notice an issue, photograph the parcel and, where reasonably possible, note the damage with the carrier. Contact us promptly at support@jewelixatelier.com and retain all packaging, labels, documents, and the item while we investigate.
For U.S. orders, risk of loss passes as provided by applicable law. For international consumer orders, risk passes at the time required by the mandatory law applicable to the transaction. Nothing in these Terms transfers risk earlier than permitted by law.
13. Thirty-Day Returns, Cancellations, and Exchanges
Returns, exchanges, and cancellations are governed by our Return, Refund, and Replacement Policy, which forms part of these Terms. In the event of conflict, mandatory consumer law prevails.
For an eligible, non-customized item, you may request a return within 30 calendar days after delivery. To begin a return, you must email support@jewelixatelier.com within that 30-day period and receive written return authorization and instructions. Unless mandatory law requires a longer period, a request made after 30 days may be declined.
An approved return must be dispatched within the time stated in our return instructions. The item must be unworn, unused, unaltered, undamaged, and in its original saleable condition, with all original tags, packaging, accessories, grading reports, and documents. All returns are subject to inspection. Where permitted by law, we may decline a discretionary return or deduct an amount reflecting diminished value if these conditions are not met.
Approved refunds will ordinarily be made to the original payment method after the returned item has been received and inspected. Original expedited-shipping charges, customs duties, taxes, brokerage fees, currency-conversion charges, and other third-party charges are non-refundable unless applicable law requires otherwise. Processing times may vary by bank or payment provider.
Unless otherwise stated in that policy:
- Custom or Personalized Products—including jewellery made or modified according to a selected ring size, engraving, metal specification, stone specification, design, or other individual instruction—are not returnable or exchangeable for change of mind, except where applicable law requires otherwise.
- Loose diamonds or gemstones specifically sourced, reserved, or purchased for your order may be final sale once sourcing or allocation has begun.
- Earrings and other pierced jewellery may be non-returnable for hygiene reasons where permitted by law and where the hygiene seal has been removed.
- An item must not be worn, altered, resized by another jeweller, engraved after delivery, damaged, or separated from accompanying documentation, grading reports, tags, or packaging if you wish to request a discretionary return.
- A return is not authorized until you receive written return instructions from us. Do not send jewellery to the registered office or any other address without authorization.
Country-Specific Consumer Rights
United States: Our 30-day return policy applies to eligible items in addition to any non-waivable rights available under applicable federal or state law. No general federal cooling-off right is represented for ordinary online purchases; the disclosed return policy and applicable state law govern, except where another mandatory rule applies.
United Kingdom: For eligible non-personalized goods purchased online, consumers retain applicable cancellation rights under the Consumer Contracts Regulations, including the right to notify us of cancellation within 14 days after delivery and then return the goods within the legally prescribed period. Our 30-day return period provides additional time to request an eligible return under our policy. Goods made to your specifications or clearly personalized are generally excluded from change-of-mind cancellation rights. Rights concerning goods that are faulty, not as described, or not of satisfactory quality remain unaffected.
Türkiye: Consumers retain any mandatory withdrawal and defective-goods rights available under Turkish consumer law for distance contracts. Where applicable, this generally includes a 14-day withdrawal right for eligible distance purchases. Goods prepared according to the consumer’s requests or personal needs may be excluded from change-of-mind withdrawal rights. Our 30-day return period applies to eligible items as an additional contractual policy and does not reduce mandatory Turkish rights.
Australia: Our 30-day return policy covers eligible change-of-mind returns, but it does not restrict the consumer guarantees under the Australian Consumer Law. Those guarantees may entitle a consumer to a repair, replacement, refund, cancellation, or compensation where goods fail to meet a statutory guarantee. These rights may continue beyond both our 30-day return period and our six-month voluntary warranty. Customization does not remove rights relating to defective, unsafe, misdescribed, or otherwise non-compliant goods.
For customers in any country, nothing in these Terms excludes mandatory rights relating to faulty, damaged, unsafe, misdescribed, or incorrectly supplied goods. If local law grants greater protection than these Terms, the mandatory local protection applies.
Unless required by law or expressly agreed by us, the customer is responsible for secure, tracked, and adequately insured return shipping and for complying with export and customs requirements. We are not responsible for an unauthorized return or for a return lost or damaged before it reaches the authorized return location, except where mandatory law provides otherwise.
14. Damaged, Defective, or Incorrect Items
If an item arrives damaged, defective, materially not as described, or different from what you ordered, contact us promptly at support@jewelixatelier.com with your order number, photographs, and a description of the issue.
We may request inspection by us or an approved specialist before determining the appropriate remedy. Depending on the circumstances and applicable law, the remedy may include repair, replacement, correction, partial refund, or full refund. Where the issue is confirmed to be our responsibility, we will cover reasonable authorized shipping costs where required by law or agreed by us.
Do not arrange a repair, resizing, or alteration through a third party before we review the claim. Unauthorized work may limit any voluntary warranty remedy if it causes or contributes to the issue, but it does not remove statutory rights that cannot be excluded.
15. Limited Warranty and Care
Any written voluntary warranty offered with a product is in addition to, and does not replace, mandatory consumer rights. Unless a longer period is stated on the product page or warranty documentation, Jewelix Atelier provides a six-month limited warranty from the delivery date against manufacturing defects in the jewellery workmanship.
The voluntary warranty does not cover normal wear and tear; scratches; loss of polish or plating; accidental damage; impact; misuse; improper storage or cleaning; exposure to chemicals; bent, stretched, or broken components caused by wear or force; gradual loosening or loss of stones; size changes; theft or loss; or repair, resizing, or alteration by a third party that causes or contributes to the problem.
Jewellery requires periodic inspection and maintenance, especially prongs, clasps, settings, and frequently worn rings. You are responsible for reasonable care of the item.
Warranty service requires prior authorization. Shipping, insurance, customs procedures, duties, and taxes for an international warranty return will be handled as stated in the applicable warranty or return instructions and subject to mandatory law. Do not send any item before receiving written instructions. The expiry of this six-month voluntary warranty does not end any statutory consumer guarantee or remedy that applies for a longer period, including rights under the Australian Consumer Law, UK consumer law, Turkish consumer law, or applicable U.S. federal or state law.
16. Promotions, Discounts, and Gift Cards
Promotions, discount codes, store credits, and gift cards may be subject to additional terms, expiry rules where lawful, product exclusions, minimum purchase values, and territorial restrictions. Unless expressly stated, offers cannot be combined, have no cash value, and cannot be applied retroactively.
We may withdraw or correct a promotion affected by fraud, misuse, technical error, or an obvious pricing mistake, subject to applicable law.
17. Intellectual Property
The Site and its content—including the Jewelix Atelier name and branding, logos, product names, jewellery designs, photographs, videos, graphics, text, software, layouts, and other materials—are owned by or licensed to Jewelix Atelier and are protected by applicable intellectual-property laws.
We grant you a limited, revocable, non-exclusive, non-transferable right to access and use the Site for personal shopping or legitimate evaluation of our products. You may not copy, reproduce, modify, publish, distribute, commercially exploit, reverse engineer, or create derivative works from Site content or jewellery designs without prior written permission.
Submitting a custom request does not transfer our pre-existing design rights, production methods, CAD elements, or intellectual property to you. You must have the right to provide any design, logo, image, inscription, or other material you ask us to use, and you are responsible for claims arising from material you supply.
18. Reviews, Feedback, and User Content
If you submit a review, photograph, testimonial, suggestion, or other content, you confirm that it is truthful, lawful, does not infringe another person’s rights, and does not contain malicious code or confidential information.
You retain ownership of your content but grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce, display, adapt for formatting, and use it in connection with operating and promoting Jewelix Atelier, unless prohibited by law. We may remove unlawful, fraudulent, abusive, irrelevant, or misleading content, but we are not required to publish every submission.
19. Third-Party Services and Links
The Site may use or link to third-party services, including payment processors, carriers, grading laboratories, social platforms, and other websites. We do not control third-party sites and are not responsible for their independent content, availability, security, terms, or privacy practices. Your use of a third-party service may be governed by that provider’s terms.
20. Disclaimer and Limitation of Liability
To the fullest extent permitted by law, the Site is provided on an “as available” basis. We do not guarantee that the Site will always be uninterrupted, error-free, or free from harmful components.
Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence where such liability cannot be excluded, breach of mandatory consumer rights, or any other liability that cannot lawfully be limited.
Subject to the preceding paragraph and to the fullest extent permitted by law, Jewelix Atelier will not be liable for indirect, incidental, special, punitive, or consequential loss, or for loss of profit, revenue, business opportunity, goodwill, or data arising from use of the Site or purchase of a product.
Where liability may lawfully be limited, our aggregate liability relating to a particular order will not exceed the amount you paid for that order. This limitation does not apply where prohibited by applicable law.
21. Indemnity for Business or Unlawful Use
If you use the Site or purchase products for business purposes, or if your unlawful conduct causes a third-party claim, you agree—where permitted by law—to indemnify Jewelix Atelier against reasonable losses, liabilities, and expenses arising directly from your breach of these Terms, infringement of third-party rights, or misuse of the Site. This clause does not apply to ordinary consumer use to the extent prohibited by law.
22. Force Majeure
We are not responsible for delay or failure caused by events beyond our reasonable control, including natural disasters, severe weather, war, terrorism, epidemic, labour disruption, carrier or customs interruption, governmental action, sanctions, internet or utility failure, or supply-chain disruption. We will take reasonable steps to reduce the effect of the event and will honor any non-waivable rights you have under applicable law.
23. Sanctions, Export Controls, and Legal Compliance
You may not purchase, export, re-export, transfer, or use our products in violation of applicable trade sanctions, anti-money-laundering laws, export controls, customs rules, or other legal restrictions. We may request information or decline, hold, or cancel a transaction where reasonably necessary for legal or compliance purposes.
24. Privacy and Electronic Communications
Our collection and use of personal information are described in our Privacy Policy. By placing an order, you agree that we may send transactional communications electronically, including order acknowledgments, confirmations, invoices, security requests, shipping updates, and policy notices. Marketing messages will be sent only as permitted by law, and you may unsubscribe using the method provided.
25. Governing Law and Disputes
These Terms and any dispute arising from them are governed by the laws of the State of Wyoming and applicable federal laws of the United States, without regard to conflict-of-laws rules.
If you are a consumer, this choice of law does not deprive you of mandatory protections available under the laws of your habitual residence. You may also have the right to bring proceedings in the courts available to you under mandatory local consumer law.
Before commencing formal proceedings, we encourage you to contact support@jewelixatelier.com so that we can try to resolve the matter promptly. Nothing in this clause requires you to waive a legal right or use an informal process where the law does not permit such a requirement.
26. Changes to These Terms
We may update these Terms to reflect changes in our business, Site, services, or legal obligations. The revised version will be posted on the Site with a new “Last updated” date. Changes apply prospectively from publication and will not retroactively alter an order already accepted unless required by law or expressly agreed with you.
Your continued use of the Site after revised Terms become effective means you accept the revised Terms for future use. Please review this page periodically.
27. Severability, Waiver, and Entire Agreement
If any provision of these Terms is held invalid or unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver of that provision.
These Terms, together with the Privacy Policy, Return, Refund, and Replacement Policy, applicable warranty terms, product description, and order confirmation, form the agreement between you and Jewelix Atelier relating to your use of the Site and purchase. If order-specific written terms expressly conflict with these general Terms, the order-specific terms control to the extent of that conflict, subject to mandatory law.
